Students with Disabilities

BAMA Institute (“the School”) complies with Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990, as amended. The School does not discriminate on the basis of disability in admission, access to, treatment in, or employment in its programs and activities. 

The School provides reasonable accommodation, academic adjustments, and auxiliary aids and services to qualified students with disabilities to ensure equal access to its educational programs and activities. The determination of appropriate accommodation is made through an individualized, interactive process. 

This policy applies to all applicants and enrolled students. 

The School’s ADA/Section 504 Compliance Coordinator is responsible for coordinating compliance and the provision of reasonable accommodations. The Coordinator may be contacted at:

Definitions 

Accommodation means a modification or adjustment to the education environment that will enable a qualified applicant or student with a disability to participate in BAMA Institute’s education program. Accommodation also includes adjustments to assure that a student with a disability has rights and privileges in education equal to those of students without disabilities. 

ADA/504 Compliance Coordinator means the official of BAMA Institute is responsible for determining and coordinating reasonable accommodation, modification, and/or auxiliary aids and services for prospective, admitted, or enrolled students. 

Auxiliary Aids and Services means accommodations that enable effective communication in the educational setting.  Auxiliary aids and services may include interpreters, notetakers, ergonomic aids, or enlarged text and real-time closed captioning. 

Student means any individual who has accepted an offer of admission, or who is registered or enrolled in coursework, and who maintains an ongoing educational relationship with BAMA Institute. 

Individual with a Disability means a person with a physical or mental impairment that substantially limits a major life activity; has a record of such impairment; or is regarded as having such an impairment. The determination of whether a student has a physical or mental impairment that substantially limits a major life activity will be made on a case-by-case basis. 

Qualified Student with Disability means a student with a disability who meets the academic and technical standards required for admission and participation in educational program(s) and activities and who has been approved by BAMA Institute for reasonable accommodations. 

Requesting Accommodations 

Applicants or students who wish to request reasonable accommodations should contact the ADA/Section 504 Compliance Coordinator as soon as possible. A request may be made at any time, including before enrollment or during participation in a program. Students are not required to disclose a disability during the admissions process. 

The Coordinator will engage in an interactive process with the student to determine appropriate accommodations. This process may include discussion of the student’s disability-related limitations and how those limitations affect participation in the School’s program. 

The School may request documentation from an appropriate licensed professional when the disability and need for accommodation are not obvious. Documentation should describe the nature of the disability, the functional limitations, and how those limitations impact the student in an academic setting. The School will not require documentation that is unnecessary to establish the existence of a disability and the need for accommodation. 

Acceptable documentation may include: 

  • Medical evaluations 
  • Audiological reports (for deaf/hardofhearing students) 
  • Psychological assessments 
  • Previous IEP/504 plans 

All disability-related documentation will be treated as confidential and maintained in accordance with applicable privacy laws. Information will be shared only with personnel who have a legitimate educational need to know in order to implement approved accommodations. 

Determination of Accommodations 

The Coordinator will evaluate each request on an individualized, case-by-case basis. The School gives primary consideration to the accommodation requested by the student but may provide alternative accommodation that is equally effective. 

The School will respond to accommodation requests in a timely manner. Once approved, the Coordinator will provide written notice to the student and will communicate approved accommodations to appropriate faculty or staff responsible for implementation.  

If a student believes that an approved accommodation has not been properly implemented, the student should promptly notify the Coordinator so that the matter can be addressed.  Accommodation is not retroactive and begin once approved. 

Limitations 

The School is not required to provide accommodations that would result in a fundamental alteration of an academic program or impose an undue financial or administrative burden. If the requested accommodation is determined to pose such a concern, the School will engage in further interactive discussion with the student to identify alternative effective accommodation. 

Grievance Procedure 

The School is committed to resolving concerns regarding disability accommodation promptly and equitably. A student who disagrees with a determination regarding accommodation, or who believes discrimination has occurred on the basis of disability, may file a grievance with the ADA/Section 504 Compliance Coordinator. 

If the matter is not resolved informally, the student may submit a written complaint to the Director of the School. The Director will review relevant information, may conduct interviews as necessary, and will issue a written decision. 

A student may also file a complaint with the United States Department of Education, Office for Civil Rights. 

Policy Dissemination and Training 

This policy will be published in the School’s catalog and on its website. The School will provide periodic training to faculty and staff regarding their obligations under Section 504 and the ADA, including the proper implementation of approved accommodation and the prohibition against retaliation.
